for the Lycka app. Last updated: 17 August 2026. This is a translation of the German version, which prevails in case of any discrepancy.
1. Provider and scope
- Lycka is provided by Jonathan Werle Media, owner Jonathan Werle, Am Römerhof 30, 52066 Aachen, Germany (lycka@jwm.media), the “Provider”.
- These terms govern your use of the app and its related services. Your own differing terms do not become part of the contract unless the Provider agrees to them expressly in writing.
- You have separate contracts with the app store operators (Apple, Google) over which the Provider has no influence and to which the Provider is not a party.
2. What Lycka is
- Lycka is an app for exactly two connected people, who can send each other photos and short notes, answer a daily question, keep shared events and lists, and share a status they set themselves.
- Lycka is expressly not an emergency, safety or health service and no substitute for therapeutic or medical advice. Do not rely on the app in urgent situations or in matters affecting health.
- Whether and when notifications arrive, and how current the home-screen widget is, depends on your device, your operating system and services operated by Apple or Google. The Provider does not owe delivery at any particular time.
- Content you send as a moment is designed to expire after 24 hours unless it is kept. The app is not an archiving or backup service. Keep your own copies of anything that matters to you.
3. Formation of contract, cost, and no payment with data
- The contract is formed when you create an account and accept these terms.
- Use is currently free of charge. Personal data is processed solely to provide the app and to meet legal obligations. Your data is not a counter-performance within the meaning of section 327(3) of the German Civil Code: there is no advertising, no sale of data, no profiling, and no monetisation of your content.
- If the Provider introduces paid features in future, they will be clearly marked before purchase and agreed separately. Existing features will not retroactively become chargeable. Statutory consumer rights, including the right of withdrawal, apply to any paid contract.
4. Your account
- Use is permitted for persons aged 18 and over. By creating an account you confirm that you are of full age.
- An account is personal and may not be shared or transferred. Keep access to your email inbox secure, because sign-in works through it.
- You may be connected with one person at a time. Share an invite code only with that person.
- You are responsible for activity through your account. Notify the Provider promptly if you suspect unauthorised access.
5. Rules of use
The following is prohibited in particular:
- posting unlawful content, in particular depictions of sexual acts involving minors, images created or shared without the consent of the person depicted, and content that incites hatred, insults or threatens;
- posting content to which you do not hold the necessary rights;
- use by persons under 18, and making the app or its content available to minors;
- attempting to connect with a person who does not want this, and any form of harassment, stalking or coercion;
- circumventing technical protection measures, automated access, scraping, reverse engineering, and anything that impairs the availability or security of the services;
- commercial exploitation of the app or its content, in particular the question cards and texts.
- In the event of breaches the Provider may remove content, restrict use temporarily, or terminate under section 10. The Provider will give appropriate weight to the severity of the breach and to your interests, and will inform you beforehand where possible and legally permitted.
- You can report unlawful content at any time to lycka@jwm.media. Please describe the content and the reason precisely enough for it to be assessed. The Provider reviews reports promptly, decides diligently, and gives reasons for its decision to the reporting person and, where affected, to the person who posted the content.
6. Your content
- Your content stays yours. The Provider acquires no ownership in it.
- You grant the Provider a non-exclusive right, unlimited in territory and limited to the term of the contract, to store your content, process it technically (such as compression and format conversion) and display it to the person you are connected with. This right serves solely the operation of the app.
- Your content is not used for advertising, marketing, training AI models, or sharing with third parties, and this right does not cover any of that.
- You are responsible for holding the necessary rights in your content and for the people visible in your photos being comfortable with it.
- When you delete an item, end the connection, or delete your account, this right ends and the content is deleted in accordance with the Privacy Policy.
7. Availability and changes to the service
- The Provider aims for operation as free of disruption as possible but does not owe any particular level of availability. Maintenance, faults at service providers and circumstances beyond the Provider’s control may cause interruptions.
- The Provider may develop the app further and change, add or discontinue features, provided this is reasonable for you and does not devalue the core of the service. The Provider will give reasonable notice in the app or by email of material restrictions.
- If the Provider discontinues the service entirely, it will give at least 30 days’ notice and an opportunity to save your content.
8. Liability
- The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulent concealment of a defect, to the extent of any guarantee given, and in cases of mandatory statutory liability, in particular under the German Product Liability Act.
- For slightly negligent breach of a material contractual obligation whose fulfilment makes performance of the contract possible in the first place and on whose observance you may rely, liability is limited to the foreseeable damage typical of this type of contract.
- Otherwise liability for slight negligence is excluded. As use is free of charge, the Provider’s liability is further limited to intent and gross negligence to the extent permitted by law.
- For loss of data, the Provider is liable under the rules above only up to the amount that would have been necessary to restore the data had you backed it up properly and regularly.
- The above provisions do not shift the burden of proof to your disadvantage. Your statutory rights as a consumer remain unaffected.
9. Indemnity
If content you post infringes third-party rights or statutory provisions, you will indemnify the Provider against justified third-party claims arising from this, including reasonable costs of legal defence. This does not apply where you are not responsible for the infringement. The Provider will inform you of any such claim promptly and give you an opportunity to comment.
10. Term, termination, deletion
- The contract runs for an indefinite period. You may end it at any time without giving reasons by deleting your account in the app or writing to lycka@jwm.media. See also Delete your account.
- The Provider may terminate on 30 days’ notice, and with immediate effect in the event of serious breaches of section 5.
- Important consequence: if the connection between two accounts is ended, or an account is deleted, shared content is permanently deleted for both sides, including kept photos. This is intended, because the content belongs to both of you, and it cannot be undone. Save anything you want to keep beforehand.
11. Changes to these terms
- The Provider may amend these terms where this is necessary because of a change in the law, in case law, for technical reasons or because the app has developed further, and where this does not unreasonably disadvantage you.
- The Provider will notify you of changes at least 30 days before they take effect, in the app or by email. If you do not object by the date stated, the changes are deemed accepted; the notice will point this out separately. You may instead end the contract at any time under section 10.
12. Governing law and jurisdiction
- German law applies. If you are a consumer habitually resident in another state, the protection of mandatory provisions of that state remains unaffected.
- For consumers, the statutory places of jurisdiction apply.
- The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final provisions
Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected. The statutory provisions apply in place of the invalid provision.
These terms replace any standard end-user licence agreement of the respective app store. Where the store’s provisions apply mandatorily, they prevail in the relationship with the store operator.
